These Terms & Conditions (“Terms”) govern your use of our website www.highlandstreehouse.com and your reservation of any accommodations offered by Highlands Treehouse Retreat (“we,” “us,” “our”). By using our website or booking a stay, you agree to these Terms.

1. Booking and Payment

All bookings must be made via our website or approved platforms.

Full payment is due at the time of booking unless otherwise specified.

We accept major credit cards and process payments securely via our third-party payment provider.

You must be at least 25 years old to make a reservation.

2. Cancellation and Refund Policy

 50% of the total reservation cost is refundable if canceled 28 days(s) before the check-in date or earlier.

0% is refundable if canceled after 28 days.

Please contact our team at info@nicholsan.webocation.net for assistance modifying or cancelling your reservation. 

No refunds for no-shows or early departures.

We reserve the right to cancel bookings due to unforeseen circumstances. In that case, a full refund will be issued.

3. Check-In and Check-Out

Check-in: 4 p.m.

Check-out: 10 a.m.

Late check-outs may be subject to a fee unless pre-approved.

4. House Rules

By booking with us, you agree to abide by the following rules:

No smoking inside the treehouses.

No pets unless explicitly permitted. All dogs must remain leashed at all times when in common areas of the retreat. Owners must clean up after their pet.

No parties or events without prior approval.

Maximum occupancy limits must be respected.

Quiet hours are from 10 p.m. – 6 a.m.

All children must be accompanied by an adult at all times in both the treehouses and throughout the retreat premises.
Children are not permitted in the Natural Spa.

We reserve the right to ask guests to leave without refund for violating house rules.

5. Liability and Indemnification

By booking a reservation, Tenant, their family members, guests and all the occupants of the rental, agree to release, indemnify and hold Highlands Treehouse Retreat LLC and Baudry Estate LLC, its members, managers, directors, officers, agents, employees, and contractors harmless from and against all injuries, claims, damages, losses, and expenses, including but not limited to, reasonable attorneys’ fees and court costs, arising out of or resulting from any negligent act or omission of Tenant, its representatives, guests, invitees, trespassers, or any other person authorized by Tenant; arising out of Tenant’s use of the subject Premises; and/or arising out of any breach of the Vacation Rental Agreement. 

RELEASE OF LIABILITY AND WAIVER OF CLAIMS. BY BOOKING A RESERVATION, TENANT AND TENANT’S INVITEES HEREBY RELEASE AND AGREE TO DEFEND AND HOLD HARMLESS HIGHLANDS TREEHOUSE RETREAT LLC AND BAUDRY ESTATE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, AND CONTRACTORS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS OR DAMAGE TO PERSON OR PROPERTY (INCLUDING, WITHOUT LIMITATION, COURT COSTS), EXPENSES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES ACTUALLY INCURRED), LIABILITIES, OBLIGATIONS, JUDGMENTS, SUITS, CLAIMS, DAMAGES, AND LOSSES, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, FOR ANY CLAIMS OR CAUSES THAT TENANT ITS SUCCESSORS, ASSIGNS, TRESPASSERS, INVITEES OR GUESTS MAY HAVE FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH ARISING FROM THE USE OF THE TREEHOUSE, WALKING NETS, BRIDGES, PLATFORMS, HOT TUBS, FIRE PITS, FIREPLACES, PLAYGROUND, SPA, WALKING TRAILS, OR ANY OTHER COMMON AREAS OF THE PREMISES.

EXPRESS ASSUMPTION OF RISK ASSOCIATED WITH  PROJECT AND ACTIVITIES

Upon booking a reservation, guest does hereby affirm and acknowledge that guest has been fully informed of the inherent hazards and risks associated with the recreational activities generally associated with staying in a treehouse and use of the walking nets, playground, spa, and walking trails.  Inherent hazards and risks include but are not limited to:

Risk of injury from the activity and equipment utilized is significant including the potential for permanent disability and death.
Activities associated with staying in a treehouse or use of the playground, walking nets, spa, and walking trails take place outdoors and therefore include risks associated with exposure to elements, excessive heat, hypothermia and encountering objects either natural or man-made causing injury and/or death.
Attack by or encounter with insects, reptiles, and/or animals.
Fatigue, chill, and/or dizziness, which increase the risk of accident.

THE DESCRIPTION OF THESE RISKS IS NOT COMPLETE AND OTHER KNOWN, UNKNOWN OR UNANTICIPATED RISKS MAY RESULT IN INJURY, ILLNESS, OR DEATH.  

Guests assume full responsibility for their own safety during their stay. 

Climbing structures, ladders, decks, walking/suspended nets, elevated platforms, hot tub, cold plunge, and sauna are used at your own risk.

Highlands Treehouse Retreat and Baudry Estate LLC are not liable for any injury, loss, damage, or theft during your stay.

You agree to be held financially responsible for any damage caused by you or your guests.

WAIVERS OF LIABILITY. Waivers of Liability for the hot tub, sauna, cold plunge, playground, all indoor and outdoor suspended nets, all bridges, all suspended platforms, and climbing structures, are herein after called special features, if so equipped. The Tenant understands there are dangers that the special features may present to adults and also to children who are not carefully supervised, as well as the danger of any person using the special features for too long a time, or if a person has health risks, or if a person uses the special feature while intoxicated or using any kind of drugs or medication, or uses the special feature if pregnant, or uses the special features recklessly or negligently. The Tenant agrees to explain the risks of using the special feature to any person in the group or person Tenant may have at the unit and to be fully and solely responsible for any accidents his guest or group may incur. The Tenant understands the risks discussed above and agrees that Tenant will assume all responsibility for Tenant and his guests for the consequences of those risks. Tenant agrees to waive any claim whatsoever against Highlands Treehouse Retreat LLC and Baudry Estate LLC for accidents or claims arising from use of special features. The Tenant also understands and agrees that tenant is responsible and liable and will pay HTR upon request for any damages that occur to the special feature and its support equipment through Tenant or Tenant’s guest’s misuse and negligence, for example, but not limited to, walking on the hot tub cover or damaging the cover and/or liner, or allowing the water level to become too low, or causing water overflow inside the unit. 

Child Supervision Required. CHILDREN UNDER THE AGE OF 16 MUST BE SUPERVISED BY AN ADULT AT ALL TIMES WHILE ON THE PREMISES. No children are permitted in the sauna or cold plunge. No babies are permitted in the hot tubs.

Your privacy is important to us. Please review our Privacy Policy for details on how we collect and use your information.

7. Intellectual Property

All content on our website, including text, photos, and logos, is the property of Highlands Treehouse Retreat and may not be reproduced without permission.

8. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of our website or services after changes indicates your acceptance of the revised Terms.
